Privacy Policy
This Privacy Policy describes our policies and practices with respect to the personally identifiable information ("Personal Information") and other data that is collected by Popared Limited ("Popared", "we", "us" and/or "our") in connection with our website and platform located at http://www.popared.com (collectively, the "Site") and our related services (together with the Site, the "Services"). Any changes we make to our privacy policy in the future will be posted on this page and, where appropriate, notified to you by e-mail. Please check back frequently to see any updates or changes to our privacy policy. Capitalized terms not defined herein shall have the meaning set forth in our Terms of Service located at: www.popared.com
Information collection
How Popared Works:
Popared provides a platform that allows Brands and Influencers to interact and engage in marketing relationships to create and/or distribute sponsored social content, often through the Influencer's Social Media Services account.
Information Collected Upon Registration for Influencers:
In order to have access to or use of certain parts of the Services, you will be required to become a registered user, and to submit certain Personal Information to Popared. Personal Information that we collect in such instances may include but not limited to your name, your email address, Popared password, Social Media Services username or handle. With respect to the Services specifically, providing additional information beyond what is required at registration is entirely optional, but enables you to better identify yourself and find opportunities in the Popared system via the Services. Optional information that you can decide to provide to us includes your first name and last name, and information that you decide to include in your public profile such as gender, Projects that you may be interested in, and bio background. It is obligatory for you to supply those personal data indicated as mandatory on the data collection form. If you do not supply such data, you may be unable to use the Services. We only retain personal data for so long as it is necessary for the fulfillment of the purpose (including any directly related purpose) for which the data is or is to be used.
Influencers and Social Media Services:
You can choose to access certain third party social media Web sites and services (such as Youtube or Instagram) (“Social Media Services”) via the Services. When you do so, you are sharing information with those Social Media Services, and the information you share will be governed by their privacy policies and terms of service. You may also be able to modify your privacy settings with these Social Media Services to, for example, control what information the Social Media Services disclose to third parties like Popared. When you add Social Media Service accounts to the Services or log into the Services using your Social Media Services account, we will collect relevant information necessary to enable our Services to access that Social Media Service, but you will provide your login information, like your password, directly to such Social Media Service (and not to Popared). As part of such integration, the Social Media Service will provide us with access to certain information that you have provided to such Social Media Service, and we will use, store and disclose such information in accordance with this Privacy Policy and, if and to the extent applicable, the policies of such Social Media Services. For example, data collected and displayed may include your Social Media Services handle, follower count, and when relevant your published Post’s like count, share count, comments count, loop count for content that you have chosen to share via the Services.
Project Submission Information from Influencers:
We collect information from you when you are submitting a bid, asking questions, and executing a Project via the Services. Such information maybe shared with other users of the Services.
Payment Information from Influencers:
We collect and store your contact details such as first name, last name, email address, phone number, your address, your financial information including but not limited to your bank account details for payments via bank transfer.
Information Collected Upon Registration for Brands:
To register as an agent of Brands, Personal Information that we collect in such instances may include your first name, last name, company name, brand name/s, email address, phone number and financial and credit information and other information that you decide to provide to us.
Project and Submission Information from Brands:
We collect information from Brands regarding any Projects that the Brands want to post through the Services. Such information is shared with other users of the Services.
Billing information from Brands:
For Brands to receive credit through the Services we collect and store your billing contact name, billing telephone number, billing address, details to perform a credit check, and in some cases your credit card details required to process the completed transaction. Credit card transactions are processed through our Payment Processor which will collect and store your payment and billing information in order to process the complete transaction. The use and storage of that information is governed by the Payment Processor's applicable privacy policy.
Communications:
When you communicate with us by sending us an email and chat feature via the Services, we will collect and store any information that is contained in your communications with us.
Surveys:
When you participate in one of our surveys, we may collect additional profile information.
Voluntary Information:
We also collect other types of Personal Information that you provide to us voluntarily, such as requested information if you contact us via e-mail regarding support for the Services.
Other:
We may also collect Personal Information at other points in our Services that state that Personal Information is being collected.
Log Data:
When you interact with the Site or use our Services, our servers automatically receive and store certain personally non-identifiable information ("Log Data"). This Log Data is collected passively and may include information such as your IP address, browser type, operating system, mobile device type, or the domain from which you are visiting, the Site pages you visit, the search terms you use, and any advertisements on which you click. For most users accessing the Internet from an Internet service provider, the IP address will be different every time you log on. We use Log Data to provide you with the Services (for example, to provide push notifications on your mobile device) and pool it with other information to monitor the use of the Services, and for the technical administration of the Services. We do not associate your IP address with any other Personal Information to identify you personally, except in cases where we are asked to comply with a subpoena or other legal demand or where we suspect that there has been a violation of our policies, our Terms of Service and/or applicable law.
Cookies:
Like many websites and services, we also use “cookie” technology to collect additional Site usage data and to improve the Site and Services. Cookies are commonly used to facilitate transmission and to provide more useful features. A cookie is a small data file that we transfer to your computer's hard disk. We do not use cookies to collect Personal Information. Also, our cookies only collect information with respect to your visits to and actions on our Site. We use these devices to find out more about the use of our websites and user preferences to improve our services. We may share summarized traffic data with Brands. We note traffic, pages visited and time spent. You are not identified. However if you agree by registering with us, we may link the information to you, so that you may receive information more suited to your interests. Popared may use both session cookies and persistent cookies to better understand how you interact with the Services and our Service, to monitor aggregate usage by our users and web traffic routing on the Site, and to improve the Site and our Services. A session cookie enables certain features of the Site and Services and is deleted from your computer when you disconnect from or leave the Site. A persistent cookie remains after you close your browser and may be used by your browser on subsequent visits to the Site. Persistent cookies can be removed by following your web browser help file directions. Most Internet browsers automatically accept cookies. You can instruct your browser, by editing its options, to stop accepting cookies or to prompt you before accepting a cookie from the websites you visit. Consult your browser’s technical information. If you do not accept cookies, however, you may not be able to use all portions of the Services or all functionality of the Services.
Pixel Tags:
In addition, we use “Pixel Tags” (also referred to as clear Gifs, Web beacons, or Web bugs). Pixel Tags are tiny graphic images with a unique identifier, similar in function to Cookies, which are used to track online movements of Web users. Pixels tags and cookies are used in those emails and at our website to help us measure the effectiveness of our advertising and how visitors use our web site. In contrast to Cookies, which are stored on a user’s computer hard drive, Pixel Tags are embedded invisibly in Web pages. Pixel Tags also allow us to send e-mail messages in a format users can read, and they tell us whether e-mails have been opened to ensure that we are sending only messages that are of interest to our users. We may use this information to reduce or eliminate messages sent to a user. We do not tie the information gathered by Pixel Tags to our users’ Personal Information.
Analytics:
We may use third party analytics services (including, but not limited to, Google Analytics) to help analyze how users use the Services. Analytics services use Cookies to collect information such as how often users open the Services and what features they use in the Services. We use this information to improve the Services. The analytics services’ ability to use and share information collected by them is restricted by their terms of use and privacy policy, which you should refer to for more information about how these entities use this information, and how you can opt-out of their use of such information.
Use of Information
Popared uses the Personal Information you provide in a manner that is consistent with this Privacy Policy. We will use your Personal Information in and outside Hong Kong in order to (a) provide you with access to and use of our Services, (b) to help us improve the content and functionality of the Services, (c) to better understand our users, (d) to provide the Services you request, (d) to provide you with customer support and troubleshoot problems, (e) to process payments and charges made through the Services via our Payment Processor, (e) to respond to your requests and communications, (f) to resolve disputes and to verify compliance with our Terms of Service, (g) to communicate with you about the Services, (h) to facilitate the posting of, submission to and running of Projects on the Site, (i) as part of our efforts to keep our site safe and secure and (j) to make suggestions and recommendations to you and other users of our site about services that may interest you or them.
In addition, we may use your contact information to market to you, and provide you with information about our products and services and the products and services of our partners that we believe may be of interest to you. If you decide at any time that you no longer wish to receive such marketing communications from us, please follow the unsubscribe instructions provided in any of the communications. Please note that even if you unsubscribe from marketing communications, we may still send you Services-related communications.
If you provide feedback to us, we may use and disclose such feedback in accordance with the terms in our Terms and Conditions, provided we do not associate such feedback with your Personal Information. We may publish user feedback from time to time, provided that we will obtain your consent prior to posting any feedback that is associated with your Personal Information. We will collect any information contained in such feedback and will treat the Personal Information in it in accordance with this Privacy Policy, provided that we may contact you in regards to such feedback.
We may also use your Personal Information to create anonymous information records by excluding information that makes the information personally identifiable to you. We use the Anonymous Information we collect to analyze trends, administer and improve the Services, gather demographic information about our user base as a whole, and better tailor our Services to our users’ needs. However, we reserve the right to use Anonymous Information for any purpose.
In an ongoing effort to better understand and serve the users of our Services, Popared also often conducts research on its customer demographics, interests and behavior based on the Personal Information and other information provided to us. This research may be compiled and analyzed on an aggregate basis, and Popared may share this aggregate data with its affiliates, agents, advertisers and business partners. This aggregate information does not identify you personally. Popared may also disclose aggregated user statistics in order to describe our Services to current and prospective business partners, and to other third parties for other lawful purposes (including providing advertising use cases to actual or potential advertisers).
Information sharing and disclosure
We may share your Personal Information with certain third parties without further notice to you, as set forth below.
Service Providers:
We engage certain trusted third parties to perform functions and provide services to us, including, without limitation, hosting and maintenance, customer relationship, database storage and management, and direct marketing campaigns. We will share your Personal Information with these third parties, but only to the extent necessary to perform these functions and provide such services.
Partners:
From time to time, Popared may partner with third parties to improve your Popared experience. In connection with the operation, promotion, advertising or marketing of our Services, we may provide certain of our partners with Personal Information (e.g., your name or Popared username) and other content or information related to you (e.g., your profile picture), or provide certain of our partners with access to our application programming interfaces (“APIs”) in order to access such information using information (such as Instagram or Youtube handles) already in their possession. Please note: each time we provide any of your Personal Information to our partners, we only provide information to these partners that is publicly available or publicly viewable in your Popared profile at the time we provide it. Please be aware that the privacy policy of such partners will govern their use of your Personal Information.
Business Transfers:
Popared may sell, transfer or otherwise share some or all of its assets, including your Personal Information, in connection with a merger, acquisition, reorganization or sale of assets or in the event of bankruptcy.
Disclosures for Legal Purposes:
Popared may disclose your Personal Information if required to do so by law or in the good faith belief that such action is necessary to (i) comply with a legal obligation or in connection with a legal investigation, (ii) protect or defend the rights or property of Popared, (iii) to protect or defend the rights or property of users of the Services or the public, or (iv) investigate or assist in preventing any violation or potential violation of the law, this Privacy Policy, or our Terms of Service.
Public Profile:
Certain portions of the information you provide to us may also be displayed in your profile. As an essential element of the Services, most of the Personal Information you explicitly provide to us when you register or update your profile is displayed on your profile. By default, your profile is available for viewing by other users. We cannot control who reads your profile or what other users may do with the information that you voluntarily post. Once you have posted information publicly, while you will still be able to edit and delete it on the Site, you will not be able to edit or delete such information cached, collected, and stored elsewhere by others.
